Yes...your not working your sick.

"Don't have no" is a double-negative, and means "does have".

So, "can a company take pay ... when you do have sick leave?" i don't think it matters. Per diem is pay per day while working. If you're not working, you don't get paid. They can't take what's yours, but they shouldn't give you what isn't yours either. You'd have to take a look at the policy or contract you signed. If you became sick while working, you may be able to claim it on a workplace health and safety form.
